Background

In accordance with section 47 of the Local Government Act 1993, Canterbury-Bankstown Council is advertising its intention to place a positive covenant on the title of Ruse Park. This is for the construction, upkeep and maintenance of a proposed bridge running across the Sydney Water canal from the eastern end of De Witt Street to the southern end of Ruse Park, Bankstown. The construction of the new bridge will replace one that was destroyed by storm damage in recent years.

A positive covenant is a legal agreement that says a landowner or someone involved in the contract must do something. This could include repairing or insuring a building/structure. In this case, it requires Council to be responsible for the ongoing upkeep of the new bridge that is being proposed.

We need to put this positive covenant in place as the canal underneath is owned by Sydney Water and for us to build the proposed bridge, we need to commit to look after it.

Proposed positive covenant

In accordance with section 47 of the Local Government Act 1993 Canterbury-Bankstown Council is advertising its intent to obtain this positive covenant as expressly authorised by Generic Plan of Management for community land and Crown land.

This will be on public exhibition for 28 days and close on Tuesday 21 April 2026, 5pm.
