Background
This proposal
The draft Planning Agreement and the Explanatory Note identifies monetary contributions and public infrastructure works arising from the planning proposal and the timing and mechanisms for delivery of these commitments by the developer.
The draft Planning Agreement includes the provision of public infrastructure and benefits such as:
- A $4 million monetary contribution for Council to spend on public recreation facilities
- Construction of new shared cycling and pedestrian pathways in Bankstown
- Creating an extension to Jacobs Street to serve as a future bus interchange and pedestrian street
- Contributing towards the upgrade of The Appian Way to a shared zone for pedestrians and vehicles
- Providing Council with a 200m2 incubator space to foster new small businesses and enterprises in Bankstown, and
- Delivery of a new 5,000m2 publicly accessible park adjacent to Rickard Road.

Below are documents that have already been exhibited during July – September 2023:
- Planning Proposal (PP-2022-1898): The aim of this Planning Proposal is to amend the planning controls in parts of the site to:
- Increase the maximum permissible height from 41m up to 86m.
- Apply a new maximum Floor Space Ratio ranging from 3.4:1 to 7:1.
- Amend Clause 6.14 ‘Restrictions on development in Zone B4 Mixed Use’ to enable residential development at ground level and above within certain parts of the site along Rickard Road and to require a minimum 50% employment generating floor space in the Town Centre Precinct on the site.
- Draft amendments to the Canterbury Bankstown Development Control Plan (DCP) 2023: a site-specific DCP has been prepared by Council that includes controls relating to built form, landscaping, solar access, setbacks, through site links and open space design requirements.
The Minister for Planning and Public Spaces has not delegated the making of the Plan to Council. Therefore should Council resolve to submit the Planning Proposal to the Department of Planning and Environment for finalisation, the Minister for Planning and Public Spaces will make a final decision whether to finalise the LEP Amendment.
