Background

In August 2021, the Local Planning Panel considered a development application (DA 605/2019) to demolish existing structures and construct a seven storey mixed use development under the provisions of State Environmental Planning Policy (Affordable Rental Housing) 2009 at 44 Kitchener Parade, Bankstown. The issue is the proposed development was unable to provide three off-street parking spaces for the commercial floor space. If it is not possible to accommodate these three spaces on the site, the property owner has the option to address this shortfall through a monetary contribution via a planning agreement.

The Local Planning Panel approved the development application on a deferred commencement basis, subject to the property owner and Council reaching an agreement on the monetary contribution required to be paid in–lieu of providing the three additional off–street parking spaces. This proposal

Council invites you to have your say on the draft planning agreement and explanatory note for 44 Kitchener Parade, Bankstown between Council and Mariam Investments Pty Ltd and KS Medical Group Pty Ltd. In response to the DA 605/2019 consent, the draft planning agreement seeks monetary contributions in-lieu of providing three off-street parking spaces as part of the development, which amounts to $125,911.83, as indexed according to Council’s Planning Agreements Policy.

The monetary contributions received by Council will facilitate additional public parking spaces in the Bankstown City Centre.

The draft Planning Agreement is consistent with the development consent (DA 605/2019), parking provisions in accordance with the Canterbury-Bankstown Development Control Plan 2023, and Council’s Planning Agreements Policy.
