Background

City of Canterbury Bankstown has prepared a planning proposal to amend the Canterbury-Bankstown Local Environmental Plan (LEP) 2023. The planning proposal seeks to update land uses and reclassify to ensure better quality development with less impact on adjoining properties. It will allow new land use as well as rezone and reclassify Council-owned land for future housing development opportunities.

These changes are part of the ongoing process of merging and aligning rules from the former Canterbury and Bankstown LEPs that align with Council’s vision for improving land use across the local area. Council resolved to proceed with this planning proposal on 24 October 2023 (link to council agenda here) and the NSW Department of Planning, Housing and Infrastructure (DPHI) approved for its exhibition on 27 May 2024.

Specific changes in the planning proposal

This planning proposal seeks to make the following changes to the Canterbury-Bankstown LEP 2023:

Changes to controls relating to educational establishments and childcare centres

  • Apply a minimum lot size provision for schools by reintroducing the planning control from the former Bankstown LEP 2015, which requires a minimum 40 metre lot width for new schools in the R2 Low Density Residential zone
  • Amend the existing design excellence provision (Clause 6.15 of the LEP) to apply to additions to existing schools if the proposed gross floor area (GFA) is 2000 square metres or greater (the control currently only applies to new school buildings with a GFA of 2000 square metres or more)

Changes to the RE1 public recreation and RE2 private recreation zones

  • Amend the stormwater management and water sensitive urban design control by removing the water sensitive urban design provision from the RE1 Public Recreation zone
  • Amend the land use table by replacing ‘early education and care facilities’ with ‘centre based childcare centres’, as uses permitted with consent in the RE2 Private Recreation

Reintroduce the ‘front building line’ definition
Reintroduce the new ‘front building line’ definition that was previously included in the former Bankstown LEP 2015 in the ‘Dictionary’ of the LEP. The proposed definition reads as follows: ‘front building line' means:

(a) for a lot that has only one road frontage—the line the consent authority is satisfied is the minimum setback a building should be from the road alignment, or

    (b) for a lot that has more than one road frontage—the shortest of the lines (excluding an access handle or right of way for access) that can be calculated under paragraph (a).’

Rezoning and reclassification of Council-owned land at Marco Avenue, Revesby

Council is proposing to rezone and reclassify Council-owned land at 75A, 75B and 75C Marco Avenue Revesby.

The planning proposal seeks to rezone the site from Public Recreation (RE1) to High-Density Residential (R4) to support residential development and reclassify from “community” land to “operational” land.

This decision, made by Council at its meeting on 24 February 2009, means that the land will change from public use (open to the community) to operational use for Council’s day-to-day activities, potentially restricting public access.

In accordance with Section 57 of the Environmental Planning and Assessment Act 1979 (EP&A Act) and Section 29 of the Local Government Act 1993 (LG Act), councils must hold a public hearing when reclassifying public land from community to operational.

This public hearing will be held as part of a separate process in accordance with LEP practice note – PN 16-001, requiring the public hearing to be held 21 days after the planning proposal is exhibited to allow the person chairing the hearing sufficient time to consider written submissions and community feedback to the proposal.
